WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT 1. In consideration for access to and use of the kayak equipment provided by LAKESIDE RENTAL ADVENTURES, LLC, I hereby, for myself, (and any minor children identified below) RELEASE, WAIVE, DISCHARGE, and HOLD HARMLESS Lakeside Rental Adventures, LLC (“Owner”), its heirs, successors and assigns, from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, that may be sustained by or to any property belonging to me (and any minor children identified below), while utilizing the equipment identified above. 2. I am fully aware of the risks and hazards connected with participating in all kayaking activities which I or the minor children identified below may undertake, including the risk of physical injury or disability as the result of such injury, and I/they am voluntarily participating in said activity, and to enter the above-named premises and engage in such activity. I VOLUNTARILY ASSUME FULL RESPONSIBILITY FOR ANY RISKS OF LOSS, PROPERTY DAMAGE OR PERSONAL INJURY that may be sustained, or any loss or damage to property as a result of being engaged in such an activity. I FURTHER UNDERSTAND THAT THE OWNER WILL NOT BE RESPONSIBLE FOR ANY MEDICAL COSTS ASSOCIATED WITH ANY INJURY I, ANY MINOR CHILD OF MINE OR THIRD PARTIES MAY SUSTAIN FROM MY USE OF THE EQUIPMENT PROVIDED BY OWNER. 3. I WARRANT THAT I HAVE LIABILITY AND/OR MEDICAL PAY INSURANCE THAT WILL COVER ANY PERSONAL INJURY, DEATH AND/OR PERSONAL PROPERTY DAMAGE SUFFERED MY MYSELF, MY MINOR CHILD(REN) OR THIRD PARTIES AS A RESULT OF MY USE OF THE AFOREMENTIONED EQUIPMENT, I hereby AGREE TO INDEMNIFY AND HOLD HARMLESS Owner from any loss, liability, damage or costs that may incur. 4. It is my expressed intent that this Waiver of Liability and Hold Harmless Agreement shall bind my heirs, assignees and personal representative, and shall be deemed as a RELEASE, WAIVER, AND DISCHARGE of Owner. I hereby agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of the State of Nebraska. 5. I agree and acknowledge that I am under no pressure or duress to sign this Waiver of Liability and Hold Harmless Agreement and that I have been given a reasonable opportunity to review it before signing. This Waiver of Liability and Hold Harmless Agreement and each of its terms are the product of an arms' length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Waiver of Liability and Hold Harmless Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision. IN SIGNING THIS RELEASE, I ACKNOWLEDGE AND REPRESENT THAT I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and statements of inducements, apart from the foregoing written agreement, have been made; I am fully competent; and I execute this document for full, adequate, and complete consideration fully intending to be bound by same.
